Terms of Service

These Terms of Service (the “Terms”) are a launch draft and must be reviewed by qualified counsel before public release. When effective, they form an agreement between you and Kanata Labs LLC, a Wyoming limited liability company (“Kanata Labs,” “we,” “us”), for your use of Dicavo (the “Service”).

The Service and eligibility

Dicavo provides language-practice features, including automated pronunciation assessment, read-aloud exercises, free-form speaking practice, and related learning tools. You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you must have permission from a parent or legal guardian. You must provide accurate registration information and keep your credentials confidential.

Your content and our license

You retain ownership of content you submit. You grant Kanata Labs a limited, non-exclusive, worldwide license to host, copy, process, and transmit that content only as needed to operate, secure, support, and improve the Service in accordance with the Privacy Policy. Do not submit content you do not have the right to use.

Acceptable use

You may not use the Service unlawfully; infringe rights; upload or generate harmful, hateful, harassing, sexually explicit, or abusive content; attempt to bypass security, rate limits, or payment controls; scrape, reverse engineer, or resell the Service except where law prohibits that restriction; or interfere with other users or the Service.

Questions, scenarios, reference answers and model texts are provided for the account holder’s own learning. Without permission, you may not automatically or systematically scrape, export, republish or sell this content, or collect the question bank through multiple accounts, shared accounts or circumvention of issuance quotas or answer-release conditions. This restriction does not prevent you from saving or using your own original answers or from uses expressly permitted by law. We may suspend or terminate access for violations or to protect the Service.

Automated feedback

Scores, transcripts, feedback, and suggestions are generated by automated systems and are for practice only. They may be inaccurate and are not an exam score, certification, medical advice, professional assessment, or guarantee of learning results.

Payments and third-party services

Paid features, credits, subscriptions, and refunds are governed by the price, purchase flow, and refund policy shown to you at the time of purchase. Third-party services and app stores may have their own terms. We do not guarantee that every feature will always be available.

Intellectual property

The Service, software, branding, and content we provide are owned by Kanata Labs or its licensors and are protected by law. Subject to these Terms, we give you a personal, limited, non-transferable, revocable right to use the Service for its intended purpose.

Disclaimers and liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties. Kanata Labs is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for a claim is limited to the greater of USD 50 or the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not permit certain limitations, so those limitations apply only to the extent permitted.

Changes, termination, and governing law

You may stop using the Service and delete your account at any time. We may change, suspend, or discontinue features and may update these Terms; material changes will be notified as required by law. If you continue using the Service after an effective update, you accept the revised Terms.

Except where your local law requires otherwise, these Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Courts located in Wyoming have exclusive jurisdiction over disputes arising from these Terms, unless applicable law gives you a non-waivable right to bring a claim elsewhere.
